A question for the more legal-minded among you.

Let's say Stocker_00 purchases the rights to a royalty-free stock photo from a website and uses it to make a Photoshop brush. They make the brush available for download on their website and give permission to others to use the brush as they like. Now along comes Designer-guy. Can he use that brush on something for commercial or private use? Can he use it on something he's selling to a client, for example?
